These Terms of Service govern the use of the EnaTouLa platform. By using the platform you agree to these terms in full.
These terms, together with our data protection and cookie policies, set out the rules for using EnaTouLa, including placing orders, making payments and arranging deliveries.
2.1 Access: Restricted to adults with full legal capacity under Mauritian law. A compatible device and internet connection are required.
2.2 Account Creation: You must register with accurate information. You are solely responsible for the security of your credentials. One account per person.
2.3 Platform Use: EnaTouLa connects you with partner businesses for ordering and delivery. You agree to use the platform lawfully at all times.
2.4 Suspension or Termination: EnaTouLa may suspend or terminate any account without prior notice for breach of these terms or suspicious activity.
2.5 Minors: Not intended for individuals under 15. Use by a minor is the full responsibility of their legal guardian.
3.1 Cancellation: You may cancel an order free of charge within 60 seconds of confirming it, provided the partner business has not yet started preparing it. After that window, or once preparation has started, cancellation is at the partner business's discretion and a refund is not guaranteed.
By confirming an order you accept these Terms in full. EnaTouLa retains electronic records of acceptance in accordance with Mauritian data retention laws.
4.1 Pricing: All prices include applicable VAT and fees, clearly broken down between the order amount and the delivery fee.
4.2 Payment: Processed through secure methods including credit/debit cards and MCB Juice. EnaTouLa is not liable for transaction failures caused by user error or bank-side issues.
4.3 Refunds: Refunds require the partner business's agreement. If payment was received but the order was never confirmed, EnaTouLa will arrange a full refund directly.
4.4 Delivery: Available only in listed zones. All delivery times are estimates. Real-time tracking and rider communication are available through the app.
4.5 Adverse Weather: Mauritius is subject to sudden heavy rainfall and cyclones. For rider safety, delivery times may be extended, and deliveries may be paused entirely, during a heavy rainfall warning or a cyclone warning of Class II or above from the Mauritius Meteorological Services. We appreciate your patience during these periods.
5.1 Choosing Pick-up: Instead of delivery, you may choose to collect your order yourself directly from the partner business ("Pick-up Order"). The same account and Terms apply to Pick-up Orders as to delivery orders.
5.2 Target Pick-up Time: The partner business will provide an estimated time when your order will be ready for collection ("Target Pick-up Time"). This is an estimate only and is not guaranteed by EnaTouLa or the partner business.
5.3 Collecting Your Order: You must collect your order at or shortly after the Target Pick-up Time. Partner businesses will hold your order for 30 minutes after the Target Pick-up Time. If you do not collect it within this window, the partner business may dispose of the order and you will still be charged in full.
5.4 Delays: If your order is not ready more than 15 minutes after the Target Pick-up Time, and the delay is not caused by a change you made after confirming the order, contact EnaTouLa and we will work with you to put things right.
6.1 Restricted Items: Age restricted products, including but not limited to alcohol and tobacco, may only be sold and handed over to persons aged 18 or over. By ordering an age restricted product, whether for delivery or Pick-up, you confirm you are at least 18 years old.
6.2 Verification: For delivery orders, the rider handing over your order may request valid photo ID before releasing any age restricted item. For Pick-up Orders, the partner business may request the same at the point of collection. Verification may be refused if you cannot provide valid photo ID, appear to be under the influence of alcohol or drugs, or (for prescription items) cannot provide a valid prescription.
6.3 Refused Items: If handover of an age restricted item is refused, it will be removed from your order and disposed of responsibly rather than delivered or handed over. The remainder of your order is unaffected. EnaTouLa will refund the affected item to your original payment method once the rider or partner business confirms the item was not provided to you.
This Article applies specifically when you book a taxi or private-hire ride through EnaTouLa (a "Ride"), in addition to the general terms above.
7.1 Booking a Ride: When you request a Ride, we match you with an independent driver-partner. The fare shown before booking is an estimate; the final fare may vary based on route taken, traffic and waiting time.
7.2 Cancellations: You may cancel a Ride free of charge shortly after a driver is assigned. A cancellation fee may apply if you cancel after the driver has started travelling to your pick-up point, to compensate the driver for their time.
7.3 No-Shows: If the driver arrives at the pick-up location and you do not appear within a reasonable waiting period, the driver may cancel the Ride and a no-show fee may be charged.
7.4 Passenger Conduct: You must not smoke in the vehicle, exceed the number of available seatbelts, act abusively towards the driver, or use the Ride for any illegal purpose. A driver may refuse to start or may end a Ride early for safety reasons.
7.5 Driver Conduct: Drivers are independent contractors, not employees of EnaTouLa, and are expected to hold any licence, permit and insurance required to legally operate as a taxi or private-hire vehicle in Mauritius, and to follow the same Ground Rules that apply to delivery riders.
7.6 Safety and Liability: EnaTouLa acts as an intermediary connecting you with independent driver-partners and is not liable for a driver's acts or omissions during a Ride. Always wear a seatbelt and follow the driver's safety instructions. Safety concerns can be reported to Rider Support and will be taken seriously.
7.7 Your Belongings: You are responsible for your own belongings during a Ride. Please check the vehicle for any personal items before you exit at the end of your Ride. If you leave something behind, contact us promptly and we will try to put you in touch with the driver, but EnaTouLa is not liable for property lost, damaged or left behind during a Ride.
EnaTouLa acts as an intermediary and is not liable for product quality, delivery delays outside its control, undisclosed food allergies, partner cancellation decisions, platform interruptions or unmet estimated delivery or pick-up times.
All content on the EnaTouLa platform is protected by intellectual property laws. Reproduction without prior written permission is strictly prohibited.
EnaTouLa shall not be liable for failure to perform due to events beyond its reasonable control including natural disasters, cyclones, strikes, epidemics or system failures.
Unresolved disputes may be referred to: Ministry of Commerce and Consumer Protection, mcpd@govmu.org · commerce.govmu.org. All remaining disputes are subject to the jurisdiction of the courts of Mauritius.
Governed by the laws of the Republic of Mauritius including the Mauritian Civil Code, Consumer Protection Act, Fair Trading Act and Data Protection Act 2017.

Conditions under which refunds may be issued for orders placed through EnaTouLa.
Due to the perishable nature of food and delivery services, confirmed orders are generally non-refundable once preparation has begun. We handle all issues fairly and promptly.
You may cancel before the partner accepts your order. A full refund will be issued to your original payment method or EnaTouLa Wallet.
Once preparation has started, cancellation is no longer possible. Each partner sets its own post-confirmation policy.
Contact support via the app or hello@enatoula.com for incorrect, incomplete or quality issues. Refunds require the partner's agreement unless the issue is directly attributable to EnaTouLa.
If your order was not delivered due to circumstances attributable to EnaTouLa or our riders, you are entitled to a full refund or re-delivery. Report within 24 hours of the estimated delivery time.
Approved refunds are processed within 5 to 10 business days, credited to your original payment method or EnaTouLa Wallet.
EnaTouLa is not liable for issues from undisclosed allergies or intolerances. Include dietary requirements in your order notes.

The EnaTouLa Wallet is an internal stored-value balance linked to your account for faster, more convenient payments.
A prepaid balance used to pay for eligible orders within the platform. It is not a financial service, bank account or investment product. It is a closed-loop facility for real orders on EnaTouLa only.
EnaTouLa never has access to your banking details. All transactions are encrypted.
Pay all or part of your order at checkout. If the balance is insufficient, complete payment with another accepted method.
Where applicable, refunds for cancelled orders are credited back to your Wallet unless a legal obligation requires an alternative method.
Wallet balances are non-refundable, non-transferable and cannot be converted into cash.
Balance remains valid while your account is active. After 24 months of inactivity, EnaTouLa may deactivate the balance with 30 days' prior notice.
All transactions from your account are considered authorised by you. Contact hello@enatoula.com immediately if you suspect unauthorised activity.

Terms that apply to promo codes, discounts, referral rewards and other promotions offered by EnaTouLa.
Promotions are open to account holders in Mauritius unless stated otherwise, and are limited to one redemption per person, per household or per account, as specified for that promotion.
Enter a valid code at checkout before confirming your order. Codes may have a minimum order value, an expiry date, or be limited to specific partners, items or payment methods. Only one promo code may be applied per order unless stated otherwise.
Where a referral program is active, both you and the person you refer may receive a reward once the referred person completes a qualifying action (such as their first order). Rewards are credited to the EnaTouLa Wallet unless stated otherwise and are subject to the qualifying conditions shown in the app at the time.
Promotional credit and referral rewards have no cash value, cannot be exchanged for cash, and cannot be transferred between accounts.
EnaTouLa may withhold, cancel or reclaim a promotion or reward, and may suspend the accounts involved, where we reasonably suspect abuse, including creating multiple accounts, referring yourself, or any other attempt to exploit a promotion outside its intended use.
EnaTouLa may modify, end or withdraw any promotion at any time without prior notice. This will not affect rewards you have already validly earned before the change.

Unauthorised use may result in legal proceedings.
Novafoods Distribution Ltd makes every effort to ensure the accuracy of information published on the platform but cannot be held responsible for inaccuracies or omissions. EnaTouLa acts as an intermediary and disclaims liability for the conduct or output of partner businesses.

These Rider Terms govern your relationship with EnaTouLa as an independent delivery rider. They apply in addition to our Ground Rules, which set out day-to-day conduct expectations for deliveries.
Riders are independent contractors, not employees of EnaTouLa (or Novafoods Distribution Ltd). You choose when and how much you work. Nothing in these Terms creates an employment, partnership or agency relationship.
2.1 Requirements: You must be at least 18, legally permitted to work in Mauritius, and provide accurate identification, vehicle and (where applicable) licence documents during onboarding.
2.2 Verification: EnaTouLa may verify submitted documents and reject or delay applications that are incomplete, expired or inconsistent.
3.1 Earnings: You are paid per completed delivery, based on the rates shown in the app at the time of the delivery. Rates may vary by zone, demand and vehicle type.
3.2 Payment Schedule: Earnings are paid out on a regular cycle disclosed to you during onboarding. EnaTouLa is not responsible for delays caused by incorrect bank details or third-party payment providers.
3.3 Taxes: As an independent contractor, you are solely responsible for declaring your earnings and meeting any tax or social contribution obligations under Mauritian law.
You are responsible for providing and maintaining your own vehicle, phone and any required delivery kit in safe working condition. You are responsible for arranging any insurance required by law for your vehicle and activity. EnaTouLa is not liable for damage, loss or injury involving your own equipment or vehicle.
You must follow the Ground Rules at all times, including safe riding practices, respectful behaviour towards customers and partners, and honest handling of orders and payments. Breach of the Ground Rules may lead to warnings, temporary suspension or permanent removal from the platform.
6.1 Your Right to Pause: Mauritius is subject to sudden heavy rainfall and cyclones. If a heavy rainfall warning or a cyclone warning of Class II or above is issued by the Mauritius Meteorological Services, or you otherwise believe conditions are unsafe, you may pause deliveries or decline a delivery without penalty to your standing on the platform.
6.2 No Pressure to Ride: EnaTouLa will never penalise you for prioritising your safety in adverse weather. Estimated delivery times shown to customers may be extended, and deliveries may be paused platform-wide, during severe weather.
6.3 Reporting: If you pause deliveries due to unsafe conditions, let Rider Support know via the app so we can update affected customers.
EnaTouLa may suspend or terminate your access to the rider platform at any time for breach of these Terms or the Ground Rules, suspicious activity, repeated customer complaints, or any other reasonable cause. You may stop using the platform at any time by contacting Rider Support.
EnaTouLa is not liable for loss of earnings due to platform downtime, adverse weather, traffic conditions or events outside its reasonable control (see Weather and Safety above and Force Majeure in our general Terms of Service).
Information you provide during onboarding (identification, vehicle and banking details) is handled in accordance with our Privacy Policy and the Mauritius Data Protection Act 2017.

EnaTouLa was born from a real gap, and a real feeling every Mauritian living abroad knows all too well.
Thousands of Mauritians live and work abroad in the UK, France, Australia, Canada and beyond. They build careers, send money home and stay connected on WhatsApp. But when they want to do something real send a meal, a gift, groceries, medicine there is no easy way. No single platform that lets them take care of the people they love back home.
That gap between love and distance is what gave birth to EnaTouLa. A way for a son in London to send dinner to his mum. A way for a daughter in Paris to make sure her father gets his medication on time. A way to say you are thinking of someone with something real.
"It started with a simple question. Why can't I send dinner to my mum back home? I'm in London, she's in Curepipe, and the best I can do is a WhatsApp message. That didn't feel right.
